Welcome.We know reading terms and conditions isn't anyone's idea of fun, so we've written these in plain English. These terms tell you everything you need to know about ordering from us — from placing an order through to delivery, returns, and your warranty. They apply every time you purchase from casamaria.co.uk and form the contract between you and us. Please read them before you order and keep a copy for your records. If anything is unclear, we're always happy to help.

 

Note:These Terms sit alongside our Privacy Policy, Delivery & Returns Policy, and Acceptable Use Policy. Together they form the complete agreement between you and Casa Maria Designs.

2. Who Can Order From Us

To place an order with Casa Maria Designs, you must:

     Be at least 18 years old.

     Be a resident of the United Kingdom (mainland UK, unless otherwise stated).

     Be purchasing for domestic, non-commercial purposes unless agreed otherwise with us in writing.

 

By placing an order, you confirm that you meet these requirements. We reserve the right to cancel and refund any order where we reasonably believe these conditions have not been met.

 

3. Customer Accounts

You may create an account on our website to manage your orders. If you do:

     You are responsible for keeping your login credentials confidential. Do not share your password with anyone.

     You are responsible for all orders, activity, and returns made through your account.

     If you believe someone has accessed your account without your permission, contact us immediately at support@casamaria.co.uk.

     Please keep your account information accurate and up to date.

 

We reserve the right to suspend or permanently close an account where we suspect fraud, abuse of our returns or promotions policy, or a breach of these Terms. Any outstanding orders will be fulfilled or refunded before closure.

 

4. Our Products

Accuracy & Descriptions

We take care to ensure all product information on our website is accurate and fairly described. That said, please be aware:

     Colours on screen may not perfectly match the real item. Studio lighting, monitor settings, and your device display can all affect the appearance of colours.

     Slight colour variations can occur between production batches. We cannot guarantee an exact colour match between orders placed at different times.

     All sizes, weights, and measurements are approximate and may vary by up to 5% due to the handmade nature of many of our products. This is normal and not a defect.

 

Important: If a specific measurement is critical to your purchase, please contact us before ordering so we can confirm exact dimensions.

 

Access & Fitting — Your Responsibility

Before ordering, it is your responsibility to ensure that:

     The item will physically fit through your doorways, hallways, stairwells, and into the intended room or space.

     You have considered all access routes from the delivery point to the final location.

     Where relevant, you have accounted for ceiling heights, alcoves, or other spatial constraints.

 

We are not liable for items that cannot be positioned in your desired location due to insufficient access or space. Return fees will apply in such cases in accordance with Section 8 of these Terms.

 

Natural & Handmade Items

Many of our products are handcrafted or made from natural materials. This is part of what makes them special — but it also means:

     No two pieces will be identical. Variations in finish, texture, and colour are a feature, not a defect.

     Vintage and shabby chic items may show deliberate signs of age or distressing. This is intentional and not a manufacturing flaw.

     Natural stone items may have veins, fissures, or surface variations. These are characteristics of the material.

     Rattan furniture is handwoven and may show slight variations in the weave pattern. This does not affect quality or durability.

 

Product Images

Product images are for illustration purposes and are usually supplied by the manufacturer. Some are photographs; others are computer-generated (CGI) to show colour and setting options. If you'd like additional images or samples before buying, just ask — we're happy to help.

 

5. Prices & Payments

Pricing

All prices shown on our website include VAT. Prices may change at any time without prior notice. We cannot offer retrospective price adjustments on items already purchased, even if the price changes afterwards.

 

Sales, Promotions & Discount Codes

     Promotional prices apply to selected products only and are subject to availability.

     Discount codes have stated expiry dates and may be restricted to certain products or minimum basket values.

     If you return an item bought with a discount code, your refund will be based on the amount you actually paid after the discount.

     Bundle returns: if you return one item from a bundle, your refund will reflect that item's discounted bundle price, not the full individual price.

     We reserve the right to cancel orders where we believe promotions or discount codes have been misused — including through the use of multiple accounts or redistribution beyond their intended audience.

 

Payment Methods

We accept the following payment methods:

     Credit & Debit Cards: Visa, Mastercard, Maestro, UnionPay, Diners Club, Discover

     Klarna — Pay in 3 interest-free instalments (subject to financial eligibility)

     Google Pay

Note:Klarna is an independent payment provider. We have no influence over their approval decisions. For Klarna queries, please contact Klarna directly.

 

Fraud & Payment Security

We take fraud seriously and apply security checks to all transactions. We reserve the right to cancel and refund any order where we reasonably suspect fraudulent activity, without prior notice. If your payment card is used without your authorisation, please contact your bank immediately.

 

Customers who raise false or unjustified chargebacks — including where goods have been correctly delivered in accordance with these Terms — may be liable to us for the value of the chargeback plus any associated bank or processing fees. We reserve the right to refuse future orders from customers who abuse the chargeback process.

 

Deposit & Balance Payments

Some items are available to order with an initial deposit. Here's how it works:

     The remaining balance becomes due on the advertised payment date, or when the item arrives in stock — whichever comes first.

     By placing a deposit order, you authorise us to automatically collect the outstanding balance at that point.

     Stock may occasionally arrive earlier than estimated. In those cases, we may collect the balance sooner than originally scheduled.

     If payment cannot be collected, we may delay dispatch, cancel the order, or release the goods for resale.

 

6. Placing Your Order

When you place an order, you'll receive an automatic confirmation email. This acknowledges receipt of your order but does not constitute our acceptance of it. Your order is formally accepted when the goods are delivered to you.

 

We reserve the right to cancel an order before acceptance if:

     The item is out of stock

     There is a pricing or description error on our website

     We are unable to fulfil the delivery

     We reasonably suspect fraud or misuse of a promotion

 

If we cancel your order, we will contact you promptly and issue a full refund, including any delivery charges paid.

 

Order Notes

You may leave a note at checkout, but notes are not binding instructions and do not form part of the contract. If something is important to you, please contact us before ordering to confirm we can accommodate your request.

 

Pre-Orders

Pre-order items are clearly labelled on the product page and at checkout, with an estimated delivery date. Please note:

     Estimated delivery dates may change due to factors outside our control. We will notify you by email of any significant changes.

     If you order a pre-order item alongside an in-stock item, we will aim to ship everything together once the pre-order arrives.

 

Accessory Compatibility

It is your responsibility to ensure any accessories, spare parts, or add-ons you order are compatible with your main product. We provide compatibility information in product titles, descriptions, and specifications — please check these carefully before ordering. We do not manually verify compatibility for every order. Incompatible accessory orders are treated as customer ordering errors and return fees may apply.

When Your Order Arrives

Please keep all original packaging until you have thoroughly checked the item and are satisfied with it. You will need the packaging if you decide to return anything. We are unable to provide replacement packaging for returns.

 

Inspecting Goods Before Assembly

Before you begin assembling or installing any item, please carefully inspect all parts, panels, frames, glass, fixings, and accessories for any visible damage or concerns.

 

Important: Do not begin assembling an item if you notice any damage. Stop immediately, take clear photographs, and contact us before proceeding.

 

If cosmetic damage is reported after assembly or installation, and there is no clear evidence that it was present beforehand, we may be unable to accept liability. To protect yourself, please:

     Photograph the packaging, all parts, and any marks or concerns before you start building.

     Contact us with photos of: the damaged part, the outer packaging, the product before assembly, and any delivery labels.

     Do not continue assembly if a fault is found — contact us first.

 

8. Returns & Cancellations

Your Statutory Right to Reject (Consumer Rights Act 2015)

Under the Consumer Rights Act 2015, if goods are faulty, not as described, or not fit for purpose, you have the right to:

     Reject the goods and receive a full refund within 30 days of delivery (the 'short-term right to reject').

     Request a repair or replacement after the 30-day period has passed.

     Receive a price reduction or a final right to reject if repair or replacement is not possible or has failed.

 

Note:These statutory rights are in addition to, and are not limited by, our own warranty or returns policies below.

 

14-Day Change of Mind Returns

We offer a 14-day change of mind return policy. To be eligible, the item must be:

     Unopened and unused

     In its original, undamaged packaging and in resalable condition

     Not assembled — assembly voids change-of-mind returns

 

You must arrange and pay for return shipping yourself. We do not offer free collection for change-of-mind returns.

 

Note:Under the Consumer Contracts Regulations 2013, you have 14 days from receipt to notify us of your intention to return, and a further 14 days to send the item back.

 

Cancellations

Free cancellation is guaranteed before dispatch, provided your request reaches us at least 24 business hours before the order is due to be dispatched and before it has entered our warehouse or courier process.

 

If your order has already been dispatched, you have two options:

     Accept the delivery, then arrange to return the item to our Runcorn warehouse at your own cost.

     Reject the delivery — we will coordinate the return through our couriers, but a return fee applies per item:

Fees are charged per item, not per order. If a delivery date has been confirmed or you have received a tracking notification, please ensure someone is available to accept the delivery. Failed deliveries will incur a charge.

9. Faulty or Damaged Items

If your item arrives damaged or develops a fault, we are sorry — and we will do our best to put things right quickly.

 

Important: Damage must be reported to us within 48 hours of delivery, with clear photographs. Late reports may affect our ability to assist.

 

     We will arrange collection or send a replacement at our expense.

     Collections typically take 1–4 business days. The item must be ready at kerbside on the agreed collection day.

     Flat-packed furniture must be disassembled and prepared for collection by the customer.

     The item remains your responsibility until it is collected.

 

If a collection fails because the item was not ready or incorrect information was provided, a £90 failed collection fee may apply. In some cases where collection is not feasible due to distance or condition, we may ask you to dispose of the item locally.

 

Missing Parts

If you receive an item with missing parts, check the instruction manual first for part names or codes, then contact us. We will source the missing parts as quickly as possible. In some cases we may need to contact the manufacturer, which can take a little longer — but we will keep you updated throughout.

Note:Clearance and ex-display items carry a 6-month guarantee on structural and manufacturing defects only. All other warranty terms remain the same. Warranties apply to domestic use within mainland UK only, require original proof of purchase, and are non-transferable.

 

What's Covered — 12-Month Standard Warranty

     Fabrics, leathers, PE rattan, HDPE slats

     Internal frames, stitching, mechanisms, electrical components, feet, fittings, knobs

     Paint and rust protection, moving parts, and accessories

 

What's Not Covered

     Accidental or deliberate damage, neglect, or misuse

     Fair wear and tear

     Cosmetic changes over time: scratches, fading, cushion flattening, UV discolouration, dye transfer, natural wood movement or shrinkage

     Weather exposure, commercial use, or repairs carried out by an unauthorised third party — any such repairs will void the warranty

     Damage caused by failure to follow care or assembly instructions

 

Extended 5-Year Structural Guarantee

Core internal frames, welds, brackets, and structural mechanisms are covered for 5 years. From years 2–5 this is a parts-only guarantee. Parts must be collected from our Cheshire warehouse — delivery and fitting are the customer's responsibility.

 

Pergola Guarantee

     10 years — against warping or bending:Structural frame & posts

     2 years — peeling, blistering, or corrosion under normal conditions:Paint & rust protection

     2 years — mechanical failure under normal use:Moving parts (louvres, hinges, cranks)

     12 months:Accessories & electronics (LED lighting, motors, blinds)

 

Important: Wind & Weather: In anything stronger than a steady breeze, louvres must be opened and windscreens fully retracted. Damage caused by strong winds, storms, hail, or failure to follow this guidance is not covered under any warranty.

 

Geographic Limitations

Warranties apply to mainland UK only. No warranty support is provided for deliveries to Northern Ireland, Isle of Man, Channel Islands, Scilly Isles, or international addresses. Offshore deliveries are final sale with no warranty.

 

How to Make a Warranty Claim

Email support@casamaria.co.uk with your order number, delivery address, a description of the issue, and at least two clear photographs showing the defect. We will respond promptly with next steps.

 

Note:Overseas parts may take up to 16 weeks. Where a dispute requires independent inspection, a £150 engineer fee applies — payable by the party found to be at fault.

 

11. Partial Fulfilment of Orders

Where an order includes multiple items (such as a matching set or bundle), each product is sold as an individual item unless explicitly stated otherwise. If we are unable to supply one item in your order due to circumstances beyond our control — for example, stock damage or a supplier shortage — we may cancel and refund the unavailable item only, and proceed with the rest of your order as normal.

 

The inability to supply part of your order does not automatically entitle you to cancel items already delivered and accepted. We may at our discretion offer a goodwill gesture, but we are not obliged to accept a return of the entire order.

 

12. Free Gifts

From time to time we may offer free items alongside a purchase — such as a rain cover with garden furniture or a heater with a pergola. Please note:

     Free gifts are not part of the contracted sale and carry no monetary value.

     The specific item received may differ from any images shown, subject to stock availability.

     Free gifts carry no manufacturing warranty and are excluded from all guarantee provisions.

     We are not liable for any issues arising from the use of a free gift. Please follow all relevant safety instructions.

 

Note:Outdoor cushions are showerproof but not waterproof. We recommend bringing them indoors during heavy rain and storing cushion covers inside over autumn and winter.

 

13. Intellectual Property & Website Use

Our Intellectual Property

All content on this website — including product photographs, descriptions, copy, logos, graphics, brand names, trade marks, and the overall site design — is owned by or licensed to MS Global Trading Ltd and is protected by UK and international copyright, trade mark, and design laws.

 

You may not, without our prior written permission:

     Copy, reproduce, republish, download, or transmit any part of this website for commercial purposes.

     Use our product images, descriptions, or brand assets on any other platform, social channel, or publication.

     Scrape, harvest, or systematically extract data from this website by automated means.

     Modify, adapt, or create derivative works from any of our content.

 

You may print or save individual pages for your own personal, non-commercial reference.

 

User-Submitted Content

If you submit content to us — including review text, photographs, or social media posts tagging our brand — you grant us a royalty-free, perpetual, worldwide licence to use, copy, publish, and display that content in our marketing materials, website, and social channels. You confirm that you own the content you submit and that it does not infringe any third party's rights.

 

This includes photographs submitted with product reviews and images in which you tag @casamaria.co.uk on social media. If you would prefer we do not use an image you have shared, please contact us and we will remove it promptly.

 

Website Availability

We aim to keep our website available at all times, but we do not guarantee uninterrupted access. We are not liable for any loss or inconvenience caused by website downtime, technical errors, or service interruptions. We reserve the right to suspend the website temporarily for maintenance, updates, or security purposes.

 

Third-Party Links

Our website may contain links to third-party websites (including our social media pages, Klarna, and Google Maps). We do not control or endorse the content, privacy practices, or accuracy of those sites. Clicking a third-party link is at your own risk, and we accept no responsibility for anything you encounter on external websites.

 

14. Our Right to Refuse Service

We reserve the right, at our sole discretion, to refuse, cancel, or restrict orders from any customer, including customers who have:

     A history of repeated returns or refund requests that we reasonably consider to be an abuse of our returns policy.

     Raised false or unjustified chargeback claims against us.

     Breached any part of these Terms and Conditions.

     Used promotional codes or offers in an unauthorised or fraudulent manner.

     Behaved in an abusive, threatening, or inappropriate manner towards our staff.

 

Where we cancel an order under this clause and payment has been taken, we will issue a full refund. This right does not affect your statutory rights as a consumer.

 

15. Complaints & Dispute Resolution

How to Complain

We aim to acknowledge all complaints within 2 business days and to provide a full response or resolution within 14 business days. For complex complaints, we will keep you updated on progress.

 

Alternative Dispute Resolution (ADR)

If we are unable to resolve your complaint to your satisfaction, you have the right to refer the matter to an approved ADR body. For furniture and home goods disputes, the relevant scheme is:

16. Events Outside Our Control

We will not be liable for any failure or delay in performing our obligations where that failure is caused by events genuinely beyond our reasonable control, including:

     Strikes, lockouts, or industrial action by third parties

     Civil unrest, terrorism, invasion, or war

     Natural disasters, severe weather, epidemics, or pandemics

     Failures in public communication or transport networks

     Unforeseen issues with carriers or logistics partners

     Supply chain disruptions, including supplier insolvency, production delays, import/export restrictions, tariff changes, or the discontinuation of a product line

 

If any such event affects your order, we will contact you as soon as possible and do our best to find a resolution.

 

17. Our Liability

We are legally responsible for supplying products of satisfactory quality, as described, and fit for purpose under UK consumer law. Our products are designed for domestic home use.

 

Our liability for any losses you suffer is limited to the original purchase price of the product involved. We are not responsible for loss of profit, business interruption, or indirect losses.

 

Nothing in these Terms limits our liability for:

     Death or personal injury caused by our negligence

     Fraud or fraudulent misrepresentation

     Rights under the Consumer Rights Act 2015 that cannot lawfully be excluded

     Defective products under the Consumer Protection Act 1987

 

Note:Your statutory rights are not affected by these Terms. For free advice, contact Citizens Advice (citizensadvice.org.uk) or your local Trading Standards office.

 

18. Severability & Entire Agreement

Severability

If any clause or provision of these Terms is found by a court to be invalid, unlawful, or unenforceable, that clause will be removed or amended to the minimum extent necessary. The remaining Terms will continue in full force and effect.

 

Entire Agreement

These Terms, together with our Privacy Policy, Delivery Policy, and Refund Policy, constitute the entire agreement between you and us in relation to your purchase. They supersede all prior communications, representations, or agreements — whether verbal or written — including anything stated in live chat, email, or marketing materials, unless expressly confirmed by us in writing.

 

19. Customer Reviews

Around 10 days after your delivery, we will send you an invitation to leave a review. Reviews are moderated before being published. Customer reviews reflect the individual opinion of the reviewer and are not part of any product specification. We are not responsible for inaccuracies in customer reviews.

 

We reserve the right to use any images or content submitted with reviews — or user-generated content tagging our brand on social media — in our marketing and promotional materials, in accordance with Section 13 of these Terms.

 

20. Your Privacy & Data

We collect and process personal data to fulfil your orders and provide customer support. We will never sell your personal data to third parties for marketing purposes. Our full Privacy Policy explains how we collect, use, store, and protect your data, and sets out your rights under UK GDPR and the Data Protection Act 2018:

By placing an order, you acknowledge that we will process your personal data as described in our Privacy Policy.

 

21. Changes to These Terms

We may update these Terms from time to time to reflect changes in law, our products, or our business practices. We will always display the version number and effective date at the top of this document. We recommend saving or printing a copy at the time of your order. Continued use of our website after changes are published constitutes acceptance of the updated Terms.

 

22. Governing Law

These Terms and Conditions are governed by the laws of England and Wales. Any dispute arising from or in connection with these Terms will be subject to the non-exclusive jurisdiction of the courts of England and Wales. If you are a consumer based in Scotland or Northern Ireland, you retain the right to bring proceedings in your local courts.
